Privacy policy for Robert Schauer Filmproduktion GmbH

Robert Schauer Filmproduktion GmbH organizes the Mountainfilm Graz international film festival (referred to in the following either by name or as “the festival” or “we”) and is responsible for the content of printed material (including the program, posters and flyers) providing information about the festival itself, as well as for the website www.mountainfilm.com. The website is created and maintained on our behalf by the company Ripix (Graz, Austria), based on a valid order data processing contract. It goes without saying that we and our partners comply with the legal provisions and requirements of data protection legislation (DSG 2000, GDPR), telecommunications legislation (TKG) and other provisions and requirements relating to data protection. We have implemented technical measures to protect our website against damage, destruction or unauthorized access.

General information

Data protection relates to personal data. The GDPR defines personal data as individual information about personal or material circumstances of a certain or identifiable natural person. This includes information such as name, postal address, email address and telephone number, but may also include usage data such as an IP address.

Cookies are small text places that are placed on users’ computers for identification and recognition purposes. The information stored in the cookies is used to control the session and in particular to improve navigation of websites.

Data collection and recording

If you ask us to provide a service, we will only collect and record your personal data to the extent that is necessary to provide the service or execute the commission.

This may necessitate sharing your personal data with companies that we use to provide the service or handle the contract. We will not share your personal data with third parties without your explicit consent, unless this is required to provide the service or execute the contract. Furthermore, we will only transmit your personal data to authorized state institutions and authorities in accordance with legal disclosure requirements, as part of the statement of accounts for the Mountainfilm Graz international film festival, or if we are required by a court decision to do so. If the latter is the case, we will notify the data subjects immediately of the transmission of their data.

Once the contract is completed, we will erase your data once its purpose no longer applies and after the retention periods under tax and commercial law and as set out in funding agreements have expired, provided that you have not explicitly consented to further use of your data (see Right to erasure).

 

Services provided:

+Website: Essential technical cookies are used to store your cookie preferences. These cookies are essential for website operation and cannot be declined.

External content (film trailers) is displayed by embedding videos via the YouTube LLC (a subsidiary of Google LLC) and Vimeo.com, Inc platforms, both with their registered office in the USA. If you consent to external content being displayed, both of these companies will place cookies on your computer and your personal data – such as your IP address and information about your browsing activity, including in relation to other websites – may be transferred to USA.

As the GDPR does not class the USA as a third country that provides adequate security for personal data, we require your consent to display external content. You can find information about how each company handles user data on the YouTube and Vimeo websites.

+ Newsletter: If you wish to subscribe to our newsletter, we require the email address at which you would like to receive the newsletter as an absolute minimum. We use other information (name and gender) to tailor the newsletter to you. The newsletter is sent out via our contract data processor rapidmail GmbH based on a legally valid data processing contract. We use the double opt-in method for our newsletter service. In other words, you will only receive our newsletter if you confirm your subscription after giving your email address by clicking on the link in the email sent to that address. This step allows rapidmail to ensure that only the actual user of the email address given can subscribe to our newsletter. You can unsubscribe from our newsletter at any time, either by emailing us or by clicking the Unsubscribe link at the bottom of the newsletter. We will record your personal data and use it to send you our newsletter until you unsubscribe. We will not share your data with third parties. You can subscribe to our newsletter by visiting our website or by ticking the checkbox on our entry cards for the competition during the festival.

+ If you make booking requests, order a “Friends Card” or subsequently book tickets via our online form or in person, we will collect your name, address, email address and telephone number. This is necessary to complete the purchase and make your reservation (to send “Friends Card” voucher codes, make bookings, answer any queries). The payment itself will be made by transferring the invoice amount to the account of Robert Schauer Filmproduktion GmbH. Bank details will be emailed to the relevant parties. Payment can also be made via PayPal; you will also be sent the account number for Robert Schauer Filmproduktion GmbH.

+ Single ticket purchase: The purchase of tickets takes place in the booking offices of our partner Oeticket (CTS Eventim Austria GmbH) or online by forwarding your request to the Oeticket webshop. As all payments are made by submitting data directly to the relevant credit institutions, the processing of this data is not the responsibility of Robert Schauer Filmproduktion GmbH. We will record the information about the completed payment transaction and the contact details provided as a voucher until the retention periods set out under tax and commercial law have expired. This information will also be sent for accounting purposes to our tax advisor with whom we have entered into a legally valid contract to protect client data.

The data will not be shared with uninvolved third parties and will not be used for any purpose other than to complete the ticket purchase and make the booking.

+ Competition for festival attendees: Entering the Mountainfilm Graz competition involves answering the competition question and providing your name and contact details on the competition entry cards that are freely available at the festival. We need your contact details (email address, telephone number or postal address) to notify any winners who are not present when the draw is made and, if necessary, to send out prizes. If you want to subscribe to our email newsletter, please tick the relevant checkbox.

+ Survey to collect audience statistics: On the back of the competition entry card you will find a brief survey where you can provide personal information about yourself. We are asking about your sporting interests, gender, age group, where you have travelled from, how you heard about the festival and how many previous festivals you have attended. The answers will help us to build a better overall picture of our audience and to tailor Mountainfilm Graz more closely to your wishes and requirements in the future. You can also enter the competition without providing this information. The Mountainfilm Graz competition entry cards are designed so that statistical data is processed separately (anonymized) from personal data. We do not create any personalized user profiles.

+ Once a year, we send our program by post to existing festival customers, who can unsubscribe from this service at any time. This service is handled by our partner Medienfabrik, based on legally valid contracts.

Assigned data use

We comply with the basic principle of assigned data use and we only collect, process and record personal data for purposes that are legitimate and have a relevant legal basis. These are:

Fulfilling orders, legal requirements, statements of account, information about the event, personal consent.

We also take in-house data protection very seriously. We require our staff and the service providers operating on our behalf to maintain confidentiality and to comply with data protection regulations.

As we continue to develop our website and/or implement new technology, we may need to amend or update this privacy policy. Robert Schauer Filmproduktion GmbH reserves the right to amend or update this privacy policy at any time with immediate effect. Accordingly, we recommend that you revisit and read the current privacy policy from time to time.

Rights to access, erasure and object, as well as contact details

You are entitled at any time, to a reasonable extent, to request access to and/or erasure of your personal data that is being/has been processed. You are also entitled to have this data rectified or blocked. In addition, you are entitled to withdraw your previous consent to the processing of your data. You may do so at any time and without giving reasons. If you do so, we will immediately cease any further processing of your personal data and irretrievably destroy the data. Please note that this means that any further cooperation will be excluded and we will no longer be able to provide any services.
